What This Means (2024 FDD)
According to Desi District's 2024 Franchise Disclosure Document, Desi District Franchise Group has the authority to allocate payments received from franchisees as it sees fit. Specifically, Desi District can apply payments to any obligation the franchisee has and in any order that Desi District determines, regardless of any specific designation made by the franchisee.
This provision grants Desi District significant control over how franchisee payments are applied. For example, if a franchisee owes money for both royalty fees and marketing contributions, Desi District can choose to apply a payment entirely to one obligation, even if the franchisee intended it to cover a portion of both. This could potentially lead to late fees or other penalties if the franchisee's preferred allocation is not followed.
For a prospective Desi District franchisee, this means understanding that payments may not always be applied as intended. It is crucial to maintain clear communication with Desi District regarding outstanding obligations and to keep detailed records of all payments made. Franchisees should be aware of this clause and its potential implications for managing their financial obligations to Desi District.
