What is the form of the Location Acceptance Letter issued by Desi District Franchise Group?

According to Desi District's 2024 Franchise Disclosure Document, the Location Acceptance Letter is issued by Desi District Franchise Group, LLC, in accordance with Section 6.1 of the Franchise Agreement. This letter serves to formally acknowledge and approve the franchisee's proposed business location. The Location Acceptance Letter will state the Location and Territory. Attachment 2 of the Franchise Disclosure Document contains the form of the Location Acceptance Letter.

Prospective franchisees must submit their proposed location to Desi District for acceptance, including all related information requested by Desi District. If Desi District does not provide written acceptance within 30 days, the location is considered rejected. Once Desi District accepts the location, it issues the Location Acceptance Letter, which specifies both the location and the territory granted to the franchisee.

The territory is determined by Desi District in its good faith discretion, substantially in accordance with Item 12 of the Franchise Disclosure Document. If Desi District fails to define the territory in writing within 60 days after the franchisee opens the business, the territory will default to the zip code containing the franchised business and the immediately surrounding zip codes, encompassing a total population of 100,000 from the business location.

It is important to note that Desi District's acceptance of a site does not constitute a guarantee of the business's success, and Desi District assumes no liability regarding the chosen location. Franchisees are responsible for finding a suitable location within the Development Area outlined on the Summary Page and should carefully consider this when proposing a location to Desi District.
