What This Means (2024 FDD)
According to Desi District's 2024 Franchise Disclosure Document, customer data is considered Confidential Information. Specifically, all customer data and other non-public data generated by the Desi District business is classified as Confidential Information and is exclusively owned by Desi District Franchise Group. However, Desi District licenses this data back to the franchisee without charge, but solely for use in connection with the operation of the Desi District business during the term of the Franchise Agreement.
This means that while franchisees collect and utilize customer data to run their Desi District franchise, the ownership of that data resides with Desi District itself. Franchisees are granted a limited license to use the data for their business operations, but they cannot use it for any other purpose or in any other business. This is a fairly standard practice in franchising, as it allows the franchisor to maintain control over valuable customer information and ensure consistency across the brand.
This has important implications for a prospective Desi District franchisee. They must understand that they are stewards of this data, not owners. They must adhere to Desi District's policies regarding data privacy and security. Upon termination of the franchise agreement, the franchisee loses the right to use the customer data, which could impact their ability to market to previous customers if they were to start a competing business. Franchisees should ensure they fully understand the scope of permitted use and the obligations regarding data protection to avoid any potential breaches or disputes with Desi District.
