What This Means (2024 FDD)

According to Desi District's 2024 Franchise Disclosure Document, a franchisee is obligated to assign the lease to the franchisor if the Franchise Agreement between them is terminated during the term of the lease, and the franchisor makes a written request for the assignment. The landlord consents to this assignment.

This provision allows Desi District to maintain control over the location of the franchise even if the original franchisee's agreement is terminated. This is a common practice in franchising, as the location is often a key component of the business's success. By securing the right to take over the lease, Desi District can ensure continued operation of a franchise at that location, either by assigning the lease to a new franchisee or operating the location themselves.

For a prospective franchisee, this clause highlights the importance of adhering to the terms of the Franchise Agreement. Failure to do so, resulting in termination, could lead to the loss of the business location. It also demonstrates the franchisor's vested interest in maintaining the leased premises for ongoing Desi District operations.
