and/or approval to open the Business is not a representation or a warranty that the Business has been constructed in accordance with any architectural, engineering, or legal standards.

  • 6.4 New Franchisee Training. Franchisee's Principal Executive and one additional chef or general manager must complete Desi District Franchise Group's training program for new

franchisees to Desi District Franchise Group's satisfaction at least four weeks before opening the Business.

  • 6.5 Conditions to Opening. Franchisee shall notify Desi District Franchise Group at least 30 days before Franchisee intends to open the Business to the public. Before opening, Franchisee must satisfy all of the following conditions: (1) Franchisee is in compliance with this Agreement, (2) Franchisee has obtained all applicable governmental permits and authorizations, (3) the Business conforms to all applicable System Standards, (4) Desi District Franchise Group has inspected and approved the Business, (5) Franchisee has hired sufficient employees, (6) Franchisee's officers and employees have completed all of Desi District Franchise Group's required pre-opening training; and (7) Desi District Franchise Group has given its written approval to open, which will not be unreasonably withheld.
  • 6.6 Opening Date. Franchisee shall open the Business to the public on or before the date stated on the Summary Page.

ARTICLE 7. OPERATIONS

  • 7.1 Compliance with Manual and System Standards. Franchisee shall at all times and at its own expense comply with all mandatory obligations contained in the Manual and with all other System Standards.

What This Means (2024 FDD)

According to Desi District's 2024 Franchise Disclosure Document, besides the Principal Executive, one additional chef or general manager must complete the initial training program to Desi District's satisfaction at least four weeks before opening the business.

Desi District also makes its standard pre-opening training available to up to two additional team members, at Desi District's headquarters and/or at a Desi District business designated by Desi District. Desi District does not charge any fee for this training, but the franchisee is responsible for travel, lodging, meals, and other out-of-pocket expenses. Desi District reserves the right to vary the length and content of the initial training program based on the experience and skill level of any individual attending the program.

After opening, Desi District may at any time require that the Principal Executive and/or any other employees complete training programs, in any format and in any location determined by Desi District. Desi District may charge a reasonable fee for any training programs. If a training program is held at a location which requires travel by the Principal Executive or any other employee, then the franchisee shall pay all travel, living and other expenses.

This means that while the Principal Executive and at least one chef or general manager are required to complete the initial training, Desi District retains the right to mandate further training for any employee at any time, potentially incurring additional costs for the franchisee.
