What This Means (2024 FDD)
According to the 2024 Desi District Franchise Disclosure Document, neither Desi District nor its affiliates currently operate, franchise, or plan to operate or franchise a business under a different trademark that would sell similar goods or services to those offered by Desi District franchisees. However, the franchise agreement does not explicitly prohibit them from doing so in the future.
This means that while Desi District is not currently engaged in any competitive business models under different trademarks, the agreement does not provide an absolute guarantee against such activities in the future. A prospective franchisee should be aware that Desi District retains the right to pursue such ventures, which could potentially impact the franchisee's market share or brand recognition.
It is common in the franchise industry for franchisors to reserve the right to explore different business models or brands. However, franchisees often seek assurances that the franchisor will not directly compete with them in a way that undermines their investment. Therefore, a potential Desi District franchisee may want to discuss this clause with the franchisor to understand their long-term strategy and the potential for future competition under different trademarks. Understanding the franchisor's intentions can help the franchisee assess the risks and benefits of investing in a Desi District franchise.
