Under what circumstances can a Dermani Medspa franchisee deviate from the System Standards?

According to Dermani Medspa's 2025 Franchise Disclosure Document, franchisees must adhere strictly to the System Standards, which include mandatory and suggested specifications, standards, operating procedures, and rules outlined in the manuals or in writing. Dermani Medspa retains the right to modify these System Standards periodically, and franchisees are obligated to implement any changes within the specified timeframe. This includes changes related to refurbishing, remodeling, upgrading the premises, or any other aspect of the franchised business, such as furniture, fixtures, décor, computer systems, or equipment.

However, a Dermani Medspa franchisee can deviate from the System Standards if they receive prior written consent from Dermani Medspa. Without this written consent, franchisees are expected to maintain all fixtures, furnishings, equipment, décor, and signs as prescribed, offer only approved services and products, and stock all required supplies and equipment in sufficient quantities.

An exception to this rule exists for the selection and use of equipment and products used in connection with medical services provided by the PC (presumably, Professional Corporation). These selections are subject to the PC's approval based on the professional opinion of its physicians, indicating that medical decisions can override standard requirements in certain cases. This exception acknowledges the importance of medical expertise in the provision of medical services within the Dermani Medspa franchise.
