What This Means (2025 FDD)
According to the 2025 Dermani Medspa FDD, the PC (Professional Corporation) operating the Dermani Medspa must provide various levels of medical spa and cosmetic services. These services must be provided by a physician or other professionally licensed persons. Additionally, the PC must offer other services and products that Dermani Medspa specifies from time to time.
The franchisee must ensure that the PC offers all medical services in accordance with the Management Agreement and the Dermani Medspa System. The PC is prohibited from offering any services or products that Dermani Medspa has not authorized. The franchisee must also ensure that the PC discontinues selling or offering any services or products that Dermani Medspa disapproves of in writing.
It is important to note that the PC will employ and control the Affiliated Physicians who will provide the actual medical services. The franchisee cannot provide any medical services, nor can they supervise, direct, or control the manner in which the PC provides medical services. This is due to various federal and state laws and state professional licensing board rules regarding the practice of medicine.
