Does Dermani Medspa have the right to operate Franchised Dermani Medspa businesses in non-traditional locations within my Development Area?

According to Dermani Medspa's 2025 Franchise Disclosure Document, Dermani Medspa retains the right to operate or grant others the right to operate Franchised Businesses, dermani MEDSPA®s, and similar medical management businesses or similar medspas or medical centers, in non-traditional or captive locations, within or outside of the Development Area. These non-traditional locations can include mobile clinics or limited service temporary locations, such as those at a "health fair" or at a convention. This right is retained by Dermani Medspa without granting any rights to the franchisee.

This means that even if a franchisee has a Development Area, Dermani Medspa can still operate or allow others to operate Dermani Medspa businesses in non-traditional locations within that area. This could include setting up temporary locations at events or using mobile clinics. As a franchisee, this means you may face competition from Dermani Medspa itself or from other franchisees in these non-traditional locations, even within your designated Development Area.

This is a fairly common practice in franchising, as franchisors often seek to expand their brand presence through various channels. However, it's important for a prospective Dermani Medspa franchisee to understand that their Development Area is not entirely exclusive and that they may encounter competition from these alternative locations.
