What This Means (2025 FDD)
According to Dermani Medspa's 2025 Franchise Disclosure Document, the specific location of the Franchised Business's premises will be at a location that Dermani Medspa approves. The location will be officially designated as the Premises once Dermani Medspa provides written approval. The boundaries of the territory will also be established at this time, and may be described in terms of street, town, or similar boundaries, or depicted on a map attached to Exhibit A.
The franchisee is responsible for finding a site that meets Dermani Medspa's site selection guidelines. If the franchisee does not already have an approved location, they must find one within 180 days of the agreement's effective date. Dermani Medspa reserves the right to designate, approve, or recommend a real estate broker to assist in this process. The franchisee must submit site approval forms and data, including site plans, financial information, and evidence of favorable prospects for obtaining the site, such as a letter of intent. Dermani Medspa has 30 days to approve or disapprove the proposed site.
The franchisee must execute a lease or purchase agreement for the premises that is coterminous with the Franchise Agreement. Dermani Medspa retains the right to review and approve the terms of the lease or purchase agreement and may require specific provisions to be included. The franchisee must provide Dermani Medspa with a copy of the executed lease or purchase agreement. The Dermani Medspa location can only be operated from the approved Premises, and relocation is not allowed without prior written consent from Dermani Medspa. The Premises can only be used for the operation of the Franchised Business and other related activities approved by Dermani Medspa in writing.
