Are the Dermani Medspa area developer's rights within the Development Area exclusive?

According to Dermani Medspa's 2025 Franchise Disclosure Document, the area developer's rights within the Development Area are nonexclusive. Specifically, Dermani Medspa retains the right to award the same Development Area to multiple area developers. However, Dermani Medspa will not sell the right to develop more Dermani Medspa locations than the total number of available territories in the Development Area.

This non-exclusivity means that a Dermani Medspa area developer may face competition from other developers within the same territory. Furthermore, Dermani Medspa has the right to acquire businesses similar to or competing with Dermani Medspa, even in the Development Area. If Dermani Medspa acquires a competing business, they may establish or grant franchises/licenses to establish new or additional competitive businesses in the Development Area. This broad reservation of rights by Dermani Medspa underscores the importance of a thorough understanding of the competitive environment and the potential for direct or indirect competition from the franchisor or its affiliates.
