Under what condition will Delta Hotels By Marriott enter into an agreement with an applicant?

According to the 2025 Delta Hotels By Marriott Franchise Disclosure Document, Delta Hotels By Marriott will enter into an agreement with an applicant if it receives full payment of the application fee. The application fee is paid via wire transfer no earlier than 10 business days after the applicant receives the Franchise Disclosure Document. The application fee may be invested, commingled with other funds, or otherwise used by Delta Hotels By Marriott as it deems appropriate.

Delta Hotels By Marriott maintains the right to approve or deny an application for one or more hotels at its sole discretion. The applicant acknowledges that they are submitting the application as the person or entity that will sign the agreements or control the proposed franchisee or area developer for each hotel. The applicant will not acquire any rights by submitting the application, regardless of whether Delta Hotels By Marriott approves it.

Any expenses incurred by the applicant in connection with the application, including costs of constructing, renovating, or operating the proposed hotel, are at the applicant's sole risk and are not being made in reliance on any action of Delta Hotels By Marriott. Delta Hotels By Marriott does not enter into oral agreements or understandings regarding franchises, so there are no agreements between the applicant and Delta Hotels By Marriott concerning the application or any franchise until a written agreement is fully executed.
