What This Means (2025 FDD)

According to Delta Hotels By Marriott's 2025 Franchise Disclosure Document, franchisees must obtain all necessary permits, certificates, and licenses required to operate the Hotel and comply with the Marriott Agreements. Specifically, before advertising, promoting, or operating the Hotel as a System Hotel, the franchisee needs to fulfill several conditions. These include securing an architect's certification confirming the Hotel's completion in accordance with the approved Plans, and providing a copy of the certificate of occupancy for the Hotel. Additionally, a certificate from a licensed architect, engineer, or recognized expert consultant on Accessibility Requirements must be delivered.

Delta Hotels By Marriott franchisees are also required to obtain zoning clearances, ingress and egress permits, and building permits in accordance with the approved Plans. Furthermore, franchisees must ensure that the fire protection and life safety systems of the Hotel are tested and inspected, verifying compliance with Delta Hotels By Marriott's fire protection and life safety standards. This inspection can be conducted by Delta Hotels By Marriott, or, if the Hotel meets certain criteria, the franchisee may use a third-party licensed fire protection engineer, engineer, or recognized expert consultant on fire and life safety requirements approved by Delta Hotels By Marriott.

These requirements ensure that the Delta Hotels By Marriott property adheres to all applicable laws and standards, maintaining safety and accessibility. The franchisee bears the responsibility for securing these permits and certifications, which are essential for the Hotel's legal and operational compliance. Failing to obtain these necessary documents can delay the opening of the Hotel and may result in penalties or legal issues.
