If Franchisor determines that it is necessary or advisable for Franchisee to secure one or more access easements across adjacent property to have the right to use driveways, drive aisles or sidewalks for pedestrian and vehicular ingress and egress, Franchisee agrees to (i) secure such easements (and the right to display signage approved by Franchisor directing traffic across the property that is subject to the easement) where indicated in the final Plans approved by Franchisor and (ii) maintain such easements and rights at all times during the Term.
Franchisee also agrees to construct and maintain at all times during the Term the method of ingress and egress indicated in the final Plans, which will lead directly to the Hotel.

What This Means (2025 FDD)
According to the 2025 Franchise Disclosure Document, Delta Hotels By Marriott franchisees must secure access easements if the franchisor deems it necessary to ensure proper ingress and egress to the property. Specifically, the franchisee must obtain easements across adjacent properties to use driveways, drive aisles, or sidewalks for both pedestrian and vehicular access. The franchisee is also responsible for displaying signage approved by Delta Hotels By Marriott to direct traffic across the easement property.
Delta Hotels By Marriott franchisees are obligated to maintain these easements and rights throughout the term of the franchise agreement. Additionally, the franchisee must construct and maintain the ingress and egress method as indicated in the final approved plans, ensuring it leads directly to the hotel.
Furthermore, before construction can begin, the Delta Hotels By Marriott franchisee needs to obtain zoning clearances and ingress/egress permits in accordance with the approved plans. This highlights the importance of adhering to the franchisor's standards and obtaining necessary approvals to ensure smooth operation and compliance with the franchise agreement.
