What This Means (2025 FDD)
According to Del Taco's 2025 Franchise Disclosure Document, a franchisee must notify Del Taco in writing within three days of receiving notice of any health or safety violation. This requirement is part of the franchisee's broader obligation to comply with all applicable federal, state, and local laws, rules, and regulations.
This notification requirement ensures that Del Taco is promptly informed of any potential issues that could affect the brand's reputation, the safety of customers and employees, or the operation of the restaurant. The franchisee must also report the commencement of any action, suit, or proceeding, and of the issuance of any order, writ, injunction, award, or decree of any court, agency, or other governmental instrumentality. Additionally, the franchisee must report any accident or injury that may adversely affect the restaurant's operation or financial condition, or give rise to liability or a claim against the franchisee or Del Taco.
For a prospective Del Taco franchisee, this means maintaining a system for quickly identifying and reporting any health or safety violations or other incidents to Del Taco within the specified timeframe. Failure to do so could potentially lead to breaches of the franchise agreement and possible penalties. This requirement highlights the importance of diligent management and adherence to all regulatory and contractual obligations.
This quick notification timeframe is fairly standard in the franchise industry, especially in the food service sector, where health and safety are paramount. Franchisees should be prepared to act swiftly and communicate effectively with Del Taco to address any issues that may arise.
