What This Means (2025 FDD)
According to Del Taco's 2025 Franchise Disclosure Document, a franchisee's right to use Del Taco's copyrighted materials, such as manuals, is contingent upon the Franchise Agreement remaining in effect. Del Taco considers these materials confidential and proprietary, and they are to be used solely for the operation of the franchised restaurant.
This means that as long as the franchisee adheres to the terms and conditions of the Franchise Agreement, they are permitted to utilize Del Taco's copyrighted materials. However, this right is not indefinite; it lasts only for the duration of the agreement. If the Franchise Agreement is terminated for any reason, the franchisee loses the right to use these materials.
This condition is standard in franchising, as it protects the franchisor's intellectual property and ensures consistent brand standards across all franchise locations. Prospective franchisees should carefully review the terms of the Franchise Agreement to understand their obligations and ensure they can comply, thereby maintaining their right to use Del Taco's copyrighted materials.
