What This Means (2025 FDD)
According to Del Taco's 2025 Franchise Disclosure Document, Del Taco has 15 days to approve or reject a proposed site plan after receiving it from the Developer. This timeframe applies once the Developer has acquired the right to use the site, obtained all necessary permits and governmental approvals, secured the rights to construct, maintain, and operate the restaurant, and entered into a construction contract.
It's important to note that if the Developer needs to make any alterations to the approved site plan or Del Taco's standard construction plans due to applicable laws or regulations, Del Taco must approve these alterations before any work begins. This approval process for alterations is separate from the initial site plan approval and could potentially affect the overall project timeline.
The FDD also clarifies that Del Taco's approval of a site plan does not constitute a representation, warranty, or guarantee regarding the future success of the site for a restaurant. The Developer bears the cost of obtaining approvals from governmental authorities for the site plan, construction plans, specifications, and layout. This highlights the franchisee's responsibility in ensuring compliance with local regulations and the inherent risks associated with site selection and construction.
