Is a Del Taco franchisee required to purchase or lease a Technology System at Del Taco's request?

At Del Taco's request, Franchisee shall purchase or lease, and thereafter maintain, the Technology System, and comply with Del Taco's requirements, specifications and policies concerning the use of technology, as they may be specified in this Agreement, or specified or modified in the Manuals or otherwise in writing, at Franchisee's own cost and expense.
Franchisee shall pay to Del Taco the then current Technology Systems Support Services Fee in the manner required by Del Taco.
Del Taco may increase this fee upon notice to Franchisee.
- 5.15.1 Del Taco shall have the right at any time to retrieve and use such data and information from Franchisee's Technology System that Del Taco deems necessary or desirable.
In view of the contemplated interconnection of computer systems and the necessity that such systems be compatible with each other, Franchisee expressly agrees that it shall strictly comply with Del Taco's standards and specifications for all item(s) associated with Franchisee's Technology System, and will otherwise operate its Technology System in accordance with Del Taco's standards and specifications.

What This Means (2025 FDD)
According to Del Taco's 2025 Franchise Disclosure Document, franchisees are required to purchase or lease a Technology System at Del Taco's request. The franchisee bears the costs and expenses associated with the Technology System and must adhere to Del Taco's specifications and policies, which may be outlined in the Franchise Agreement, the Manuals, or other written communications. Franchisees must also pay the then-current Technology Systems Support Services Fee, which Del Taco can increase with notice.
Del Taco has the right to access and use data from the franchisee's Technology System as deemed necessary or desirable. Franchisees must strictly comply with Del Taco's standards for all items related to the Technology System to ensure compatibility between systems. This includes installing Required Software and implementing Technology Upgrades as reasonably requested by Del Taco in writing, all at the franchisee's expense.
Del Taco also has the right to establish new technology standards and implement changes to the system, requiring franchisees to abide by these new standards and pay any associated fees. If any technology used by the franchisee does not meet Del Taco's specifications, the franchisee must cease using it, and Del Taco can remove it from the Restaurant. All data collected from customers is owned exclusively by Del Taco, and franchisees must provide or delete this data upon request.
