What This Means (2025 FDD)

According to Del Taco's 2025 Franchise Disclosure Document, Del Taco has specific rights regarding the inspection of a restaurant during its construction phase. Del Taco's authorized personnel are permitted to enter the restaurant at any time during normal business hours, with or without prior notice, to inspect and examine the construction. The purpose of these inspections is to ensure that the construction complies with the terms outlined in the franchise agreement.

This means that a Del Taco developer must allow Del Taco representatives access to the construction site. Furthermore, the developer is obligated to ensure that their general contractor cooperates with Del Taco's representatives, providing any assistance that is reasonably requested during the inspection. This cooperation is crucial for maintaining a transparent construction process and addressing any concerns promptly.

If Del Taco identifies any deficiencies during the inspection, the developer is responsible for correcting these issues at their own expense. The developer must act promptly upon receiving notice from Del Taco to rectify any problems detected during the inspection. This requirement ensures that the restaurant is built according to Del Taco's standards and specifications, which is vital for maintaining brand consistency and quality. This also places the financial burden of correcting any construction flaws or deviations from the approved plans squarely on the developer, highlighting the importance of adhering to Del Taco's guidelines from the outset.

For a prospective Del Taco franchisee, this underscores the importance of meticulous planning and adherence to Del Taco's construction standards. Failing to comply with these standards can lead to costly corrections and potential delays in opening the restaurant. Therefore, maintaining open communication with Del Taco's representatives and promptly addressing any concerns they raise during inspections is essential for a smooth construction process.
