NOW THEREFORE, in consideration of the mutual covenants, agreements and obligations set forth below, and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties agree as follows:
DEFINED TERMS
"Billable Services" means any Support Service, other than Covered Services, performed by Del Taco, or an Approved Vendor, at the times determined by Del Taco, in its sole discretion, or the Approved Vendor, which will include, but not be limited to, the period of time deemed necessary by Del Taco or the Approved Vendor to provide Support Services to implement the Software and Licensee's Covered Equipment for the preparation of the store opening, or conversion, to Covered Equipment.
"Confidential Information" means the Software and Documentation, and the terms and conditions of this Agreement, which each are confidential and proprietary to Del Taco.

What This Means (2025 FDD)
According to Del Taco's 2025 Franchise Disclosure Document, 'Billable Services' are defined as any support service, excluding Covered Services, that is performed either by Del Taco or an approved vendor. These services are provided at times determined by Del Taco or the approved vendor at their discretion.
Billable Services include the period of time deemed necessary by Del Taco or the Approved Vendor to provide Support Services to implement the Software and Licensee's Covered Equipment for the preparation of the store opening, or conversion, to Covered Equipment. Del Taco may perform on-site services such as computer and software installation, upgrades, and troubleshooting and repairs.
As a franchisee, you're responsible for Billable Services Fees for any work Del Taco performs at your restaurant. You're also responsible for the travel costs incurred by Del Taco representatives to reach your location. The rates for billable services will be communicated to you before the services begin, and you'll receive periodic invoices that are due upon receipt.
