What This Means (2025 FDD)

Based on the 2025 Degree Wellness Franchise Disclosure Document, if a franchisee fails to take required actions after receiving notice from Degree Wellness, Degree Wellness has the right to enter the premises and make the required changes at the franchisee's expense if the franchisee does not take action within 10 days of notice. Degree Wellness can also terminate the franchise agreement if the franchisee does not comply with the agreement.

Specifically, if the franchisee does not take the actions Degree Wellness requests within 10 days after receiving notice, Degree Wellness has the right to enter the premises and make the necessary changes at the franchisee's expense. The franchisee must then reimburse Degree Wellness for these expenses upon demand. Furthermore, the franchisee irrevocably appoints Degree Wellness as their attorney-in-fact to take these actions if the franchisee fails to do so within the 10-day period after termination of the agreement.

This means that a Degree Wellness franchisee has a short window to correct any issues after receiving notice before Degree Wellness takes action or terminates the agreement. The franchisee is responsible for covering the costs Degree Wellness incurs if they have to step in to make corrections. This could create a financial burden for the franchisee if they are unable to resolve the issue promptly.
