Under what conditions might Degree Wellness direct me to modify or discontinue the use of any Mark?

According to Degree Wellness's 2025 Franchise Disclosure Document, Degree Wellness reserves the right to direct a franchisee to modify or discontinue the use of any Mark. Specifically, if Degree Wellness, in its sole judgment, deems it advisable for the franchise to modify or discontinue using any Mark, or to use additional or substitute trade or service marks, the franchisee must comply. This includes Marks used as the name of the Franchise.

The franchisee is responsible for all expenses associated with complying with Degree Wellness's directions to modify or discontinue the use of a Mark or to adopt additional or substitute marks. The franchisee must act within a reasonable time frame after receiving notice from Degree Wellness.

This clause gives Degree Wellness significant control over its brand and image. While Degree Wellness may change its Marks and specifications when it believes such changes will benefit the System, it is important to note that Degree Wellness need not reimburse the franchisee for any loss of revenue due to any modified or discontinued Mark or for expenses in changing to, or promoting, a modified or substitute trademark or service mark.
