What This Means (2025 FDD)
According to Degree Wellness's 2025 Franchise Disclosure Document, a franchisee's Protected Territory can only be modified or altered if both the franchisee and Degree Wellness mutually agree to the change. This agreement must be documented. The FDD explicitly states that Degree Wellness cannot unilaterally alter or modify the Protected Territory under any other circumstances.
This stipulation provides a level of security for Degree Wellness franchisees, ensuring that their exclusive territory remains intact unless they consent to changes. This prevents the franchisor from encroaching on a franchisee's territory without their agreement, which could potentially harm their business.
However, it is important for prospective Degree Wellness franchisees to understand the implications of this clause fully. While it protects against unilateral changes by the franchisor, it also means that any desired modifications to the territory, even if beneficial to the franchisee, require the franchisor's consent. Franchisees should carefully consider the potential long-term implications of their Protected Territory and ensure it aligns with their business goals before agreeing to the terms of the Franchise Agreement.
