What This Means (2025 FDD)

According to Degree Wellness's 2025 Franchise Disclosure Document, the Licensed Provider is granted a sub-license to use Degree Wellness's trade and service marks, names, service marks and other commercial symbols, including the marks "d" (stylized) and "DegreeWellness". This sub-license is revocable, non-assignable, and non-exclusive and is valid during the Agreement Term. The Licensed Provider must obtain prior consent from Degree Wellness before using these marks.

The Licensed Provider must adhere to all applicable laws, rules, and regulations when using the Degree Wellness marks. They must also follow the specific rules and requirements set forth by Degree Wellness and operate under the direction of the Management Company. The agreement explicitly states that the Licensed Provider has no ownership rights or interests in the marks, System materials, forms, intellectual property, or décor items, as Degree Wellness retains sole ownership.

This license to use the Degree Wellness marks automatically ends upon the termination of the Agreement. This underscores the importance of understanding the terms of the agreement and complying with all requirements to maintain the right to use the Degree Wellness branding and System. Failure to comply with these rules could result in the termination of the agreement and the loss of the right to operate under the Degree Wellness brand.
