- a. Through the expenditure of considerable time, effort and money, we and our affiliates have devised a system for the establishment and operation of a Degree Wellness business model that specializes in innovative self-care solutions that leverage heat, cold, light and advanced nutrients to enhance physical and mental health and other related services and products (all of which we refer to in this Agreement as the "System"). The System includes procedures, specifications, techniques and procedures that we may designate for operating a wellness business. This business model includes a studio model offering all of our franchised services and products (individually, a "Studio" or "Studio," and collectively, the "Studios" or "Studios"). Subject to an additional fee, we also offer additional programs, products and services as more fully described herein, which additional programs, products and services may change from time to time. We identify the System by the use of certain trademarks, service marks and other commercial symbols, including the marks "Degree Wellness," and certain associated designs, artwork and logos, which we may change or add to from time to time (the "Marks").

What This Means (2025 FDD)
According to Degree Wellness's 2025 Franchise Disclosure Document, the 'Marks' associated with the Degree Wellness System include the trademark "Degree Wellness" and any associated designs, artwork, and logos. Degree Wellness may change or add to these marks from time to time.
The franchisee's right to use these marks is derived solely from the franchise agreement and is limited to the operation of the franchise in compliance with the agreement. This includes adhering to all standards, specifications, and operating procedures prescribed by Degree Wellness, as well as the timely payment of all required fees. The agreement emphasizes that any unauthorized use of the marks during or after the term of the agreement constitutes a breach of contract and an infringement of Degree Wellness's rights.
Degree Wellness retains the right to regulate the use of its marks, including their use in electronic media such as websites and domain names. All goodwill established through the franchisee's use of the marks inures exclusively to the benefit of Degree Wellness and its affiliates. The franchise agreement does not confer any goodwill or other interests in the marks to the franchisee, other than the right to operate the franchise in compliance with the agreement. Degree Wellness reserves the right to change its marks and specifications if it believes such changes will benefit the system, and franchisees are required to conform to these changes at their own expense.
