What This Means (2025 FDD)

According to Degree Wellness's 2025 Franchise Disclosure Document, the landlord will not be responsible for any expenses or damages resulting from Degree Wellness's actions to protect its system and proprietary marks. Specifically, Degree Wellness has the right to enter the business premises at any time to make modifications or alterations necessary to protect its system or to address any defaults under the Franchise Agreement or the lease.

This provision is included in the lease agreement between the franchisee and the landlord, ensuring that Degree Wellness can take necessary actions without being held liable for trespass or any other legal issues. The landlord agrees to this condition and will not be responsible for any costs or damages that arise from Degree Wellness's actions in this regard.

This clause protects Degree Wellness's interests by allowing them to maintain the standards and integrity of their brand and system. For a prospective franchisee, this means that Degree Wellness has the authority to intervene if the franchisee is not adhering to the franchise agreement or if the premises require modifications to align with Degree Wellness's standards. However, it's important for franchisees to understand that while the landlord won't be responsible, the franchisee may ultimately bear the financial responsibility for these changes, depending on the terms of their franchise agreement.
