What happens if Degree Wellness disapproves advertising proposed by a franchisee?

Degree_Wellness Franchise · 2025 FDD

Answer from 2025 FDD Document

You may develop, at your cost, advertising and promotional materials for your own use, but may not use them until after we have approved them in writing. You must submit to us for our approval samples of all advertising and promotional materials not prepared or previously approved by us that you wish to use. We will not unreasonably withhold our approval. If we do not approve any materials submitted to us within 15 days of receiving them, they will be deemed not approved. Our actual or deemed approval will not mean that we have analyzed or approved any such materials with respect to any state, local or administrative law, rule or regulation that may be applicable to a franchise's practice of health related services in its State of licensure.

What This Means (2025 FDD)

According to Degree Wellness's 2025 Franchise Disclosure Document, franchisees must submit all advertising and promotional materials not already approved by Degree Wellness for written approval before use. Degree Wellness promises not to unreasonably withhold approval. However, if Degree Wellness does not approve the submitted materials within 15 days of receipt, the materials are considered not approved.

This means that a Degree Wellness franchisee cannot use advertising or promotional materials that have not been explicitly approved or implicitly approved through the franchisor's failure to respond within 15 days. This requirement allows Degree Wellness to maintain brand consistency and ensure that all marketing efforts align with their standards.

It is important to note that even if Degree Wellness approves the advertising materials, this approval does not constitute an analysis or endorsement regarding compliance with any state, local, or administrative laws related to health service practices in the franchisee's state of licensure. The franchisee remains responsible for ensuring their advertising complies with all applicable regulations.
