What This Means (2025 FDD)
According to Degree Wellness's 2025 Franchise Disclosure Document, for any arbitration or mediation involving a franchise purchased in Washington, the site will be located either in the state of Washington, in a place mutually agreed upon at the time of the arbitration or mediation, or as determined by the arbitrator or mediator at the time of arbitration or mediation.
This means that if a Degree Wellness franchisee in Washington has a dispute with the franchisor that goes to arbitration or mediation, the proceedings will likely take place within Washington state. However, there is room for negotiation or for the arbitrator/mediator to decide on a different location. This provides some protection for the franchisee, as it avoids the expense and inconvenience of having to travel to a distant location for dispute resolution.
It is also important to note that if litigation is not precluded by the franchise agreement, the franchisee can bring an action or proceeding related to the sale of franchises or a violation of the Washington Franchise Investment Protection Act in Washington. This offers an additional layer of protection for Degree Wellness franchisees in Washington, ensuring that they can pursue legal action within their own state under certain circumstances.
