What This Means (2025 FDD)
According to Degree Wellness's 2025 Franchise Disclosure Document, several methods are acceptable for delivering notices under the franchise agreement. These include delivery by hand, which is considered delivered at the time of the exchange. Notices can also be sent via telecopy, facsimile, or other electronic systems, with delivery deemed to occur one business day after transmission.
Another option is using a reputable commercial courier service for next business day delivery, which also results in the notice being considered delivered one business day after being handed to the courier. Finally, notices can be sent through the U.S. mail via Registered or Certified Mail, Return Receipt Requested, with postage prepaid. In this case, delivery is considered to have occurred three business days after the notice is placed in the mail.
All notices must be addressed to the appropriate party at their designated address. For notices to Degree Wellness, the address is Attn: Amanda Watts, 200 Riverside Ave., Jacksonville, FL 32202. For notices to the franchisee, the address is the one listed in Exhibit 2 of the franchise agreement or the most current principal business address that the notifying party has been advised of. It is important to ensure that Degree Wellness actually receives any required notice, payment, or report during regular business hours on the date it is due, or that it is postmarked at least two days before the due date, to avoid it being considered delinquent.
