What This Means (2025 FDD)
According to the 2025 Crowne Plaza Franchise Disclosure Document, IHG (InterContinental Hotels Group) does not provide any warranties for products or services under the Participation Agreement. Instead, Crowne Plaza franchisees must rely on the warranties, if any, provided by the actual service provider, manufacturer, or vendor. IHG explicitly disclaims all warranties, whether expressed or implied, related to the services, network connectivity, software, hardware, or systems, including warranties of merchantability, satisfactory quality, and fitness for a particular purpose.
This means that as a Crowne Plaza franchisee, you cannot hold IHG liable for any defects or deficiencies in equipment or services provided under the agreement. Instead, you are responsible for pursuing any warranty claims directly with the supplier, manufacturer, vendor, or their insurance company. This arrangement shifts the responsibility for product and service quality away from IHG and onto the individual providers.
This disclaimer also extends to any representations or promises made by IHG. The FDD states that IHG has not made any promises, representations, warranties, or guarantees of any kind to the franchisee. Therefore, prospective franchisees should conduct thorough due diligence on all suppliers and service providers and carefully review any warranties they offer, as these will be the franchisee's sole recourse in case of defects or issues. This is a common practice in franchising, where the franchisor often acts as a facilitator but does not directly guarantee the performance of third-party suppliers.
