Is there any pending material litigation regarding Crown Gold Exchange's trademark use?

According to Crown Gold Exchange's 2024 Franchise Disclosure Document, there is no pending material federal or state court litigation regarding their use or ownership rights in a trademark. The trademark 'Crown Gold Exchange' is registered with the United States Patent and Trademark Office under registration number 4765544, with a registration date of June 30, 2015. The trademark is owned by WAM Gold, LLC, an affiliate of Crown Gold Exchange, and Crown Gold Exchange has the exclusive right to sublicense the trademarks to franchisees throughout the United States under an Intercompany License Agreement.

Crown Gold Exchange will defend a franchisee (at their expense) against any legal action by a third party alleging infringement if the franchisee uses their trademarks in accordance with the franchise agreement. They will also indemnify the franchisee for expenses and damages if the legal action is resolved unfavorably to the franchisee. However, Crown Gold Exchange may require a franchisee to modify or discontinue using a trademark, at the franchisee's expense.

Franchisees are obligated to notify Crown Gold Exchange of any use of, or claims of rights to, a trademark identical or confusingly similar to a trademark licensed to them, though the franchise agreement does not require Crown Gold Exchange to take affirmative action when notified of these uses or claims. Crown Gold Exchange retains the right to control any administrative proceedings or litigation involving a trademark licensed by them to the franchisee.
