Are there any pending infringement proceedings regarding the Crown Gold Exchange trademark?

According to Crown Gold Exchange's 2024 Franchise Disclosure Document, there are no pending infringement, opposition, or cancellation proceedings concerning their trademarks. The trademark is owned by WAM Gold, LLC, an affiliate of Crown Gold Exchange. Crown Gold Exchange has been granted the exclusive right to sublicense the trademarks to franchisees throughout the United States under an Intercompany License Agreement with WAM Gold, LLC. This agreement is perpetual and can only be modified by mutual consent.

The FDD also states that there is no pending material federal or state court litigation regarding Crown Gold Exchange's use or ownership rights in a trademark. Furthermore, Crown Gold Exchange states that they do not know of either superior prior rights or infringing uses that could materially affect a franchisee's use of the principal trademarks.

Crown Gold Exchange will defend a franchisee (at their expense) against any legal action by a third-party alleging infringement by the franchisee's use of the trademark and will indemnify the franchisee for expenses and damages if the legal action is resolved unfavorably to them, provided the franchisee uses the trademarks in accordance with the franchise agreement. However, Crown Gold Exchange may require a franchisee to modify or discontinue using a trademark, at the franchisee's expense.
