What System Standards must a Crown Gold Exchange business conform to before opening?

Before opening, Franchisee must satisfy all of the following conditions: (1) Franchisee is in compliance with this Agreement, (2) Franchisee has obtained all applicable governmental permits and authorizations, (3) the Business conforms to all applicable System Standards, (4) Crown Gold Franchising has inspected and approved the Business, (5) Franchisee has hired sufficient employees, (6) Franchisee's officers and employees have completed all of Crown Gold Franchising's required pre-opening training; and (7) Crown Gold Franchising has given its written approval to open, which will not be unreasonably withheld.

  • "System Standards" means, as of any given time, the then-current mandatory procedures, requirements, and/or standards of the System as determined by Crown Gold Franchising, which may include without limitation, any procedures, requirements and/or standards for appearance, business metrics, cleanliness, customer service, design (such as construction, decoration, layout, furniture, fixtures and signs), equipment, inventory, marketing and public relations, operating days, operating hours, presentation of Marks, product and service offerings, quality of products and services (including any guaranty and warranty programs), reporting, safety, technology (such as computers, computer peripheral equipment, smartphones, point-of-sale systems, back-office systems, information management systems, security systems, video monitors, other software, backup and archiving systems, communications systems (including email, audio, and video systems), payment acceptance systems, and internet access, as well as upgrades, supplements, and modifications thereto), uniforms, and vehicles.

Franchisee shall not rely upon any information provided or opinions expressed by Crown Gold Franchising or its representatives regarding any architectural, engineering, or legal matters (including without limitation the Americans With Disabilities Act) in the development and construction of the Business, and Crown Gold Franchising assumes no liability with respect thereto. Crown Gold Franchising's inspection and/or approval to open the Business is not a representation or a warranty that the Business has been constructed in accordance with any architectural, engineering, or legal standards.

Crown Gold Franchising may vary or waive any System Standard for any one or more Crown Gold Exchange franchises due to the peculiarities of the particular site or circumstances, density of population, business potential, population of trade area, existing business practices, applicable laws or regulations, or any other condition relevant to the performance of a franchise or group of franchises.

According to Crown Gold Exchange's 2024 Franchise Disclosure Document, before opening a Crown Gold Exchange business, a franchisee must ensure the business conforms to all applicable System Standards. Crown Gold Franchising must also inspect and approve the business prior to opening. Additionally, the franchisee must obtain all applicable governmental permits and authorizations.

The FDD defines "System Standards" as the mandatory procedures, requirements, and/or standards of the Crown Gold Exchange system as determined by Crown Gold Franchising. Furthermore, the franchisee's Principal Executive must complete Crown Gold Franchising's training program for new franchisees to Crown Gold Franchising's satisfaction at least four weeks before opening the business. The franchisee must also hire sufficient employees and ensure that all officers and employees have completed all required pre-opening training. Finally, Crown Gold Franchising must provide written approval to open the business, which will not be unreasonably withheld.

It is important to note that Crown Gold Franchising does not provide any guarantees regarding architectural, engineering, or legal matters, including compliance with the Americans With Disabilities Act. The franchisee is responsible for ensuring compliance with all applicable laws and regulations. Crown Gold Franchising may also vary or waive any System Standard for any one or more Crown Gold Exchange franchises due to the peculiarities of the particular site or circumstances.
