What This Means (2024 FDD)
According to the 2024 Crown Gold Exchange Franchise Disclosure Document, both Crown Gold Exchange and the franchisee have the ability to seek injunctive relief from an arbitrator. This is permissible until the arbitration award is officially rendered or the controversy reaches a resolution.
Furthermore, either party can seek interim or provisional injunctive relief from a court with jurisdiction, without relinquishing their right to arbitrate the matter under the Franchise Agreement. This provides flexibility in addressing urgent situations that may require immediate legal intervention while still adhering to the arbitration agreement.
This clause ensures that both Crown Gold Exchange and its franchisees have access to legal remedies necessary to protect their interests during a dispute. It allows for swift action to prevent potential harm while the arbitration process is underway, maintaining a balance between dispute resolution and immediate protection of rights.
