What This Means (2024 FDD)

According to the 2024 Franchise Disclosure Document, the Guaranty for a Crown Gold Exchange franchise does extend beyond the term of the Franchise Agreement. Specifically, the guarantor's obligations regarding confidential information and covenants not to compete continue even after the termination or expiration of the Franchise Agreement.

The guarantor must maintain the confidentiality of Crown Gold Exchange's proprietary information both during and after the franchise term. This obligation is indefinite, meaning it has no set end date. The guarantor also agrees to certain non-compete restrictions, preventing them from engaging with any competitor within a five-mile radius of the franchisee's territory for two years after the agreement expires or is terminated.

These post-term obligations are typical in franchising to protect the franchisor's brand, trade secrets, and customer relationships. The guarantor's ongoing responsibility for confidentiality ensures that sensitive business information remains protected, while the non-compete agreement prevents unfair competition from individuals with inside knowledge of the Crown Gold Exchange system. A prospective franchisee should carefully consider these long-term obligations and ensure they are comfortable with the restrictions before entering into the agreement.
