What This Means (2024 FDD)
According to Crown Gold Exchange's 2024 Franchise Disclosure Document, the franchisor has the authority to allocate payments from franchisees as it sees fit. Specifically, Crown Gold Exchange can apply payments to any obligation the franchisee has, in any order they choose. This is regardless of any specific instructions or designations the franchisee might make regarding how the payment should be applied.
This clause gives Crown Gold Exchange significant control over the application of payments. For a franchisee, this means that even if they intend a payment to cover a specific fee or debt, the franchisor can choose to apply it elsewhere. This could potentially lead to late fees or other penalties if the franchisee's intended obligation remains unpaid according to Crown Gold Exchange's records.
Franchisees should be aware of this provision and maintain careful records of all payments and outstanding obligations to avoid potential discrepancies or disputes with Crown Gold Exchange. It is crucial to understand how Crown Gold Exchange is applying payments to ensure all obligations are met in a timely manner and to avoid any penalties or late fees. This type of clause is not uncommon in franchise agreements, as it protects the franchisor's financial interests and provides flexibility in managing franchisee accounts.
