What This Means (2024 FDD)
According to Crisp & Green's 2024 Franchise Disclosure Document, a tenant is not allowed to lease the premises without the addendum to the lease agreement. The addendum is a required part of the leasing process, ensuring that the landlord acknowledges the franchisor's rights and interests in the property.
Specifically, the addendum outlines the franchisor's rights regarding remodeling and décor, restrictive covenants, and assignment of the lease. It also details the conditions under which the franchisor can take over the lease, including in cases of tenant default or termination of the franchise agreement. This protection is crucial for Crisp & Green to maintain brand consistency and operational control.
The addendum also states that it does not create any liability for Crisp & Green or its affiliates, clarifying that the tenant is not an agent or employee of the franchisor. This provision protects Crisp & Green from potential legal issues arising from the tenant's actions. Furthermore, any modifications to the addendum must be in writing and approved by Crisp & Green, ensuring that the franchisor retains control over any changes to the lease agreement.
