What ownership interest must the Operating Partner maintain in the franchise for Crisp & Green?
Crisp_Green Franchise · 2024 FDDAnswer from 2024 FDD Document
Each entity must designate an Operating Partner who must meet with our approval. The Operating Partner must maintain a substantial (generally at least 5%, although we will make case-by-case determinations in our discretion) direct or indirect ownership interest in you, be the General Manager of your Franchised Restaurant or (with our prior approval) designate another person meeting with our approval to be the General Manager of your Franchised Restaurant. If you will develop multiple Franchised Restaurants pursuant to an Area Development Agreement, your Operating Partner will be your Approved Operator unless (with our prior approval) you designate another person meeting with our approval to be your Approved Operator. Your Operating Partner must participate in and complete Crisp Academy, and must have the authority to make decisions on your behalf and bind you with respect to matters and agreements between you and us.

What This Means (2024 FDD)
According to Crisp & Green's 2024 Franchise Disclosure Document, the Operating Partner must maintain a substantial ownership interest in the franchise. Generally, this means the Operating Partner needs to have at least 5% direct or indirect ownership in the franchise entity. However, Crisp & Green retains the discretion to make case-by-case determinations on this percentage.
This requirement ensures that the Operating Partner has a vested interest in the success of the Crisp & Green franchise. By mandating a minimum ownership stake, Crisp & Green aims to align the Operating Partner's goals with the overall performance and profitability of the business. This arrangement is fairly common in franchising, as it encourages active and committed management.
It's important for potential Crisp & Green franchisees to understand that while 5% is the general guideline, the actual required ownership percentage could vary. Franchisees should discuss this requirement with Crisp & Green during the due diligence process to clarify the specific expectations and ensure they can meet the ownership obligations. Additionally, the Operating Partner must be approved by Crisp & Green and be the General Manager, or designate an approved General Manager.
