What This Means (2024 FDD)

According to Crisp & Green's 2024 Franchise Disclosure Document, if a tenant violates the terms of their lease, the landlord must provide written notice of the default to Crisp & Green Franchising LLC on the same day they notify the tenant. This allows Crisp & Green the option, but not the obligation, to resolve the tenant's default.

The notice must be sent via registered or certified mail, with prepaid postage, to Crisp & Green Franchising LLC at 746 Mill Street E, Wayzata, Minnesota 55391. Crisp & Green can change this address by providing the landlord with written notice of the new address. The landlord is also responsible for notifying both the tenant and Crisp & Green of any changes to the landlord's mailing address for notices.

This requirement ensures that Crisp & Green is informed of any lease defaults, giving them the opportunity to protect their brand and the franchise system. By having the right to cure the default or accept assignment of the lease, Crisp & Green can maintain control over the location and operation of the franchise, even if the franchisee is unable to meet their obligations. This clause is designed to protect the interests of both Crisp & Green and the landlord, while also providing a safety net for the franchisee.
