You agree to send us a description of the proposed site, including a summary of the items listed above, along with a letter of intent or other evidence confirming your favorable prospects for purchase or lease of the proposed site. We will use reasonable efforts to approve or disapprove the proposed site within thirty (30) days after receiving your written proposal. If we do not approve of a proposed site, you must identify and notify us of new sites until we approve a site for the Franchised Restaurant. Upon our approval of a site, you agree that we will insert its address into Exhibit B, and it will be the Premises. The failure to insert such address into in Exhibit B shall not automatically affect the enforceability of this Agreement.
3.03 Purchase or Lease of Premises. We have the right to approve the terms of any site acquisition documents for the Premises. You must deliver to us a copy of the proposed site acquisition document. Within ten (10) days after our approval of the proposed site acquisition document, you must provide us with (1) a fully signed site
acquisition document and (2) the franchise addendum to lease agreement attached hereto as Exhibit C, which contains certain required terms and provisions of the site acquisition document, fully executed by you and the landlord. You may not modify the terms of the site acquisition document or franchise addendum to lease agreement without our approval.

What This Means (2024 FDD)
According to Crisp & Green's 2024 Franchise Disclosure Document, if a franchisee and Crisp & Green have not agreed upon a location before signing the agreement, the franchisee is responsible for selecting a site within the designated area outlined in Exhibit B. The franchisee must then seek written approval from Crisp & Green before committing to any site acquisition documents like a lease or purchase contract.
The franchisee's description of the proposed site must include a summary of demographic characteristics, traffic patterns, parking availability, the character of the neighborhood, competition from other businesses (including their proximity and nature), other commercial characteristics, and the proposed site's size, appearance, and other physical characteristics.
In addition to this description, the franchisee must also provide a letter of intent or other evidence that confirms favorable prospects for purchasing or leasing the proposed site. Crisp & Green will then use reasonable efforts to approve or disapprove the proposed site within 30 days of receiving the franchisee's written proposal. If the initial site is not approved, the franchisee must continue to identify and submit new sites for approval until one is accepted by Crisp & Green.
