You must open the Franchised Restaurant in compliance with our standards within nine months after the date of your Franchise Agreement. If you have signed an Area Development Agreement, you must open your first Franchised Restaurant in compliance with our standards within nine months after the date of your first Franchise Agreement and each of your subsequent Franchised Restaurants in compliance with our standards according to the opening deadlines set forth in the Area Development Agreement you will sign at the same time you sign your first Franchise Agreement.

What This Means (2024 FDD)
According to Crisp & Green's 2024 Franchise Disclosure Document, if you sign an Area Development Agreement, you must open your first Franchised Restaurant within nine months after the date of your first Franchise Agreement. Subsequent Crisp & Green restaurants must be opened according to the deadlines outlined in the Area Development Agreement, which you will sign concurrently with your initial Franchise Agreement.
Crisp & Green requires you to develop the Franchised Restaurant at your own expense, including preparing all construction and remodeling plans to comply with laws and regulations. These plans and site surveys must be submitted to Crisp & Green for approval before construction begins. You are also responsible for obtaining all necessary construction and occupancy licenses and permits, developing the premises, and installing all required fixtures, furnishings, equipment, and signs.
It is important to provide Crisp & Green with at least 30 days' prior notice of your planned opening date. You cannot open for business until Crisp & Green confirms that your restaurant meets their opening requirements. These requirements include full payment of the initial franchise fee and any other outstanding amounts, successful completion of Crisp Academy, and receipt of your insurance certificates. Failure to open within the specified timeframe, without an approved extension, may result in penalties, including a Minimum Royalty Fee of $7,500 plus 7% of your Gross Sales each month until the restaurant opens.
