What is a Crisp & Green franchisee required to use in the development and operation of the franchise?

We grant to you, under the terms and conditions of this Agreement, the right to develop and operate the number of CRISP & GREEN restaurants identified in the Rider (the "Franchised Restaurants"), using the Marks and System and operating within the territory described in the Rider (the "Development Area").
Each Franchised Restaurant must be developed and operated by you under a separate Franchise Agreement that you enter into with us.
You will be solely responsible for identifying, submitting for our approval, and securing specific sites for each Franchised Restaurant.
Except as specifically set forth in this Agreement, the establishment and operation of each Franchised Restaurant must be in accordance with the terms of the applicable Franchise Agreement.
D. You acknowledge and agree that other than as set forth in Section C above, we and our Affiliates (and our respective successors and assigns, by purchase, merger, consolidation or otherwise) retain all rights and discretion with respect to the Marks, the System, the sale of products and services similar or dissimilar to those offered by Crisp & Green Restaurants, and the operation or franchising of Crisp & Green Restaurants anywhere located or to be located, and may engage in any business activities whatsoever, within or outside the Development Area, whenever and wherever we desire.
Unless we specify otherwise in writing, Franchisee shall provide Catering Service and/or Delivery Service from the Franchised Restaurant in accordance with all applicable terms and conditions of this Agreement and the Operations Manual. Franchisee shall not establish another outlet or property (other than the Franchised Restaurant's Premises) for use in connection with Catering Service or Delivery Service, provided that, if Franchisee has been approved to operate a Crisp & Go Location, Franchisee may operate the Crisp & Go Location at the site within your Designated Area that we have approved in writing.
You must maintain the condition and appearance of, and perform maintenance with respect to vehicles, servewear and equipment used in connection with the provision of Catering Services and/or Delivery Services in accordance with our standards, specifications and procedures, and consistent with the image of CRISP & GREEN as first class, clean sanitary, attractive and efficiently-operated food service businesses. You must ensure that all catering and delivery drivers strictly comply with all applicable laws and maintain adequate motor vehicle liability insurance in the amounts that we periodically specify.

What This Means (2024 FDD)
According to the 2024 Crisp & Green Franchise Disclosure Document, a franchisee is granted the right to develop and operate Crisp & Green restaurants using the Marks and System within a specific Development Area. The franchisee must adhere to a Development Schedule outlined in a Rider, with timely development and operation being essential. Each restaurant requires a separate Franchise Agreement.
The franchisee is responsible for identifying and securing sites for each Franchised Restaurant, subject to Crisp & Green's approval. The establishment and operation of each Franchised Restaurant must align with the terms of the applicable Franchise Agreement. Crisp & Green retains rights and discretion over the Marks, the System, and the operation or franchising of Crisp & Green Restaurants, allowing them to engage in business activities within or outside the Development Area.
Furthermore, unless specified otherwise in writing by Crisp & Green, the franchisee must provide Catering and/or Delivery Services from the Franchised Restaurant, following all terms and conditions of the Franchise Agreement and the Operations Manual. The franchisee cannot establish additional outlets for Catering or Delivery Services, except for approved Crisp & Go Locations. They must also maintain vehicles and equipment used for catering and delivery according to Crisp & Green's standards and ensure that all delivery drivers comply with applicable laws and maintain adequate motor vehicle liability insurance.
