What This Means (2024 FDD)

According to the 2024 Crisp & Green Franchise Disclosure Document, franchisees must acknowledge that the agreement's terms are reasonably necessary to maintain uniformity and high-quality standards across all Crisp & Green restaurants. This is explicitly stated to protect the goodwill of the Marks and the integrity of the Crisp & Green System. By agreeing to the franchise terms, franchisees recognize the importance of upholding brand standards to preserve the brand's reputation.

This acknowledgment means that franchisees have a direct responsibility to operate their restaurants in a manner that reflects positively on the Crisp & Green brand. This includes adhering to operational guidelines, maintaining quality control, and providing consistent customer service. Failing to meet these standards could harm the brand's reputation and, consequently, the goodwill associated with the Marks.

Furthermore, the agreement emphasizes that the success of the franchise is largely dependent on the franchisee's own business abilities, efforts, and financial resources. While Crisp & Green provides the System and brand recognition, it is the franchisee's responsibility to execute the business plan effectively and contribute to the overall success and positive image of the brand. This highlights the importance of franchisee engagement and commitment to upholding brand standards to protect the goodwill of the Marks.

In essence, the Crisp & Green franchise agreement places a shared responsibility on both the franchisor and the franchisee to protect the brand's goodwill. While Crisp & Green provides the framework and support, the franchisee's adherence to the System and commitment to quality are crucial in maintaining and enhancing the brand's reputation.
