What This Means (2024 FDD)
According to Crisp & Green's 2024 Franchise Disclosure Document, in the event of the death or permanent disability of an individual franchisee, the responsibility for transferring the franchise interest falls to the executor, administrator, or other personal representative of the deceased or disabled person. This representative is tasked with transferring the interest in the Franchise Agreement or the interest in the franchisee entity to a third party.
However, this transfer is not unconditional. The third party must be approved by Crisp & Green, and the transfer must comply with all applicable provisions outlined in Section 13 of the franchise agreement. This process must be completed within a reasonable timeframe, specifically not exceeding nine months from the date of death or permanent disability.
This provision ensures that in unforeseen circumstances, there is a clear process for the continuation or transfer of the Crisp & Green franchise, protecting both the interests of the franchisee's estate and the integrity of the Crisp & Green brand. The nine-month timeframe provides a structured period for the representative to manage the transfer while adhering to the franchisor's approval process, maintaining brand standards and operational consistency.
