- A. You will sign the Franchise Agreement for your first Franchised Restaurant concurrently with this Agreement. A separate Franchise Agreement must be signed for each Franchised Restaurant as it is identified, which must be consistent with the Development Schedule. Upon the execution of each Franchise Agreement, the terms and conditions of the Franchise Agreement control the establishment and operation of the Franchised Restaurant.

What This Means (2024 FDD)
According to Crisp & Green's 2024 Franchise Disclosure Document, when signing a Development Agreement, the franchisee will also sign the Franchise Agreement for their first Franchised Restaurant. The Development Agreement grants the franchisee the right to develop and operate a specified number of Crisp & Green restaurants within a defined territory, according to a set development schedule. Each restaurant to be developed under the Development Agreement requires a separate Franchise Agreement.
This concurrent signing ensures that the franchisee is immediately committed to opening their first location while also securing the rights to develop additional locations within the Development Area. The terms and conditions of each Franchise Agreement will then control the establishment and operation of each Franchised Restaurant.
This arrangement is fairly typical in area development franchise models. It allows Crisp & Green to secure a commitment for multiple locations while providing the franchisee with a defined schedule and territory for expansion. However, the franchisee must adhere to the Development Schedule, as failure to do so could result in Crisp & Green terminating the agreement or altering the Development Area.
