What This Means (2024 FDD)
According to the 2024 Crisp & Green Franchise Disclosure Document, franchisees must acknowledge several key aspects of the franchise agreement. Specifically, the franchisee acknowledges that they have read the agreement and the Franchise Disclosure Document, understand the terms, and accept them as reasonably necessary to maintain uniformity and protect the goodwill of the Crisp & Green brand. This indicates that Crisp & Green emphasizes the importance of franchisees being fully informed and agreeing to the standards of the franchise system.
Furthermore, the franchisee acknowledges conducting an independent investigation of the business and recognizes the competitive nature and risks associated with the restaurant industry. They also acknowledge that success depends on their own abilities, efforts, and financial resources, and that they have not relied on any guarantees regarding revenues, profits, or success. This acknowledgement serves to protect Crisp & Green from potential claims that franchisees were misled about the profitability or ease of running a franchise.
In addition to these general acknowledgements, the franchisee and their principal owners must truthfully fill out the Franchisee Acknowledgment attached as Exhibit F to the agreement. This likely involves providing accurate information and certifications related to their background, financial status, and other relevant details. By requiring these acknowledgements, Crisp & Green aims to ensure that franchisees are fully aware of the terms, risks, and responsibilities associated with operating a Crisp & Green franchise.
