- D. Area Developer desires to obtain certain development rights to open and operate Crepe Delicious Restaurants under the System and the Marks, as well as to receive other assistance provided by Franchisor in connection therewith.

What This Means (2025 FDD)
According to the 2025 Crepe De Licious FDD, an Area Developer seeks specific rights to develop the Crepe De Licious brand within a defined territory. The Area Developer wants the right to open and operate Crepe Delicious Restaurants under the Crepe De Licious system and use their Marks. They also want to receive assistance from Crepe De Licious in connection with these activities.
Specifically, Crepe De Licious grants the Area Developer the right, and imposes the obligation, to develop a certain number of Crepe Delicious Restaurants, as detailed in Exhibit A of the Area Development Agreement. Each restaurant developed must operate under a separate Crepe Delicious Holding USA, Inc. Franchise Agreement. The Area Developer must execute a Franchise Agreement for each restaurant according to the development schedule outlined in Exhibit A. Each restaurant must be located within the Development Area specified in Exhibit A.
The Area Developer gains a degree of exclusivity within their Development Area. Crepe De Licious agrees not to establish or license others to establish Crepe Delicious Restaurants within the Development Area, as long as the Area Developer complies with their obligations under the Area Development Agreement and all Franchise Agreements. However, Crepe De Licious retains significant rights, including the right to operate or franchise Crepe De Licious Restaurants outside the Development Area, operate non-store-front businesses under the Crepe De Licious Marks within or outside the Development Area, and operate businesses using the Marks at various venues like airports, malls, and entertainment facilities, even within the Area Developer's territory.
