What This Means (2025 FDD)

According to the 2025 Crepe De Licious Franchise Disclosure Document, a franchisee must obtain prior written approval from Crepe De Licious if they want to use their own advertising materials. This approval can be granted or denied at Crepe De Licious's sole discretion. Crepe De Licious will review the franchisee's request and respond in writing within 30 days from the date they receive all the necessary information. Failure by Crepe De Licious to respond within this timeframe is considered a disapproval of the request.

All advertising, promotional, and marketing content must be clear, factual, and not misleading. It must also conform to the highest standards of ethical advertising and marketing, as well as any advertising and marketing policies that Crepe De Licious may require from time to time. The use of logos, marks, and other name identification materials must adhere to Crepe De Licious's approved standards. Franchisees cannot use Crepe De Licious's logos, marks, and other name identification materials on items to be sold or services to be provided without prior written approval.

If Crepe De Licious approves promotional items or services that will be sold in the Crepe De Licious franchise, these items or services must be included in the franchisee's Gross Revenues and will be subject to Royalty Fees and Advertising Fees. If a franchisee uses unauthorized advertising materials, they must pay a fee of $500 per occurrence to Crepe De Licious, or to the Advertising Fund if one has been established. This policy ensures that all marketing efforts align with the brand's standards and protects the integrity of the Crepe De Licious brand.

This requirement is fairly standard in franchising, as franchisors typically want to maintain control over brand messaging and ensure consistency across all locations. The $500 fee for unauthorized advertising is a deterrent to ensure franchisees adhere to the approval process. Prospective franchisees should carefully consider these requirements and factor in the time and potential costs associated with seeking approval for their own advertising materials.
