For Crepe De Licious, what happens after a location for the Restaurant, Kiosk, or Food Truck is approved?

After we have approved a location for your Restaurant, Kiosk, or Food Truck, we shall complete the Approved Location and the Territory in Attachment A-1. As the Territory is dependent on the location of the Restaurant, Kiosk, or Food Truck, we will present you with the Territory upon the identification of the site for the Restaurant, Kiosk, or Food Truck. If you do not wish to accept the Territory, you may choose another site location and we will present you with another Territory based on the site selected.
The Restaurant or Kiosk must be located at the Approved Location.
The Food Truck must always be located within the Territory.
If a particular site has not been selected and approved at the time this Agreement is signed, Attachment A will describe the Approved Location in general terms.
In that case, after we have approved a location for your Restaurant, Kiosk, or Food Truck, we will unilaterally modify Attachment A and the specific address of that location will automatically become the Approved Location as if originally set forth in Attachment A instead of the general description.
You have no rights under this Agreement to use, and you will not use, the System or Marks at any other location, without our prior express written consent.
You will not relocate the Restaurant, Kiosk, or Food Truck without our prior express written consent.
You acknowledge that our approval of a location for the Restaurant or Kiosk is not a representation or warranty that the Restaurant, Kiosk, or Food Truck will be successful.
Any Approved Location or Territory for a Food Truck will be non-exclusive and subject to our unilateral revision at anytime during the Franchise Agreement at our sole discretion.
- 5.05 Restaurant, Kiosk, or Food Truck Image. You will at all times maintain your Restaurant, Kiosk, or Food Truck according to the System Standards, including those standards prescribed in the Operations Manual, such as standards and specifications relating to the safety, maintenance, cleanliness, sanitation, function and appearance of the Restaurant, Kiosk, or Food Truck and your equipment and signs, as well as the requirement that the employees of the Restaurant, Kiosk, or Food Truck will be required to wear uniforms and to maintain a standard of appearance while employed at the Restaurant, Kiosk, or Food Truck. You will maintain and operate the Restaurant, Kiosk, or Food Truck in a good, clean, wholesome manner.

What This Means (2025 FDD)
According to Crepe De Licious's 2025 Franchise Disclosure Document, after a location is approved for a Restaurant, Kiosk, or Food Truck, the franchisor will complete Attachment A-1 to the Franchise Agreement with the specific Approved Location and Territory details. The territory is dependent on the location, and Crepe De Licious will present the franchisee with the Territory details once the site is identified. The franchisee has the option to reject the proposed Territory and select another site, which would then lead to the presentation of a different Territory based on the new site. If a site has not been selected and approved when signing the Franchise Agreement, Attachment A will describe the location in general terms, without conferring any territory rights.
If a particular site has not been selected and approved at the time the Franchise Agreement is signed, Attachment A will describe the Approved Location in general terms. Once Crepe De Licious approves a location, they will modify Attachment A unilaterally to include the specific address, which then becomes the Approved Location. The franchisee is not allowed to use the Crepe De Licious System or Marks at any other location without prior written consent from the franchisor, and relocation of the Restaurant, Kiosk, or Food Truck also requires prior written consent.
It is important to note that Crepe De Licious's approval of a location does not guarantee the success of the Restaurant, Kiosk, or Food Truck. Furthermore, any Approved Location or Territory for a Food Truck is non-exclusive and can be revised by Crepe De Licious at any time during the Franchise Agreement at their sole discretion. Once the location is approved, the franchisee must maintain their Restaurant, Kiosk, or Food Truck according to the System Standards, including safety, maintenance, cleanliness, and appearance, and ensure employees wear uniforms and maintain a standard of appearance.
