You must purchase, install, maintain in sufficient supply, and use, only fixtures, furnishings, equipment, signs, and supplies that conform to the standards and specifications described in the Operations Manual or otherwise in writing.
You must use the computer programs and related materials developed for use in the operation of Crepe de licious Franchises. The Software (defined in Item 11) includes the POS system software. You must pay us a technology fee for website hosting and other services. You must pay a separate license fee for the POS software this may be direct to the POS vendor or paid to us, as determined by us. The purchase of the Software license may include technical support. See Item 6 and Item 7 for more information about the technology fee and POS software license. Franchisees are required to purchase computer systems from our designated suppliers. You must use the computer hardware and software, including the point-of-sale system that we periodically designate to operate your Crepe de licious Business. You must obtain the computer system, software licenses, maintenance and support services, and other related services from the suppliers we specify (which may be limited to us and/or our affiliates). Neither we nor our affiliates are currently suppliers of the computer system, except for the services procured for the technology fee described above.
You must use such third party delivery companies as we designate in the Operations Manual or otherwise. We currently contract with some third party delivery, ghost kitchen, and retail supply companies to expand the availability of our products to consumers through delivery, catering, and grocery or other retail stores. These third party delivery, ghost kitchen, and retail supply companies may deliver and service customers within your protected territory, you have no rights to any compensation for any actual or perceived revenue loss due to our contracts with third party delivery, ghost kitchen, or retail supply companies.
You must obtain the insurance coverage required under the Franchise Agreement. The insurance company must be authorized to do business in the state where your Crepe de licious Business is located, and must be approved by us. It must also be rated "A" or better by A.M. Best & Company, Inc. We may periodically increase the amounts of coverage required under these insurance policies and/or require different or additional insurance coverage at any time. All insurance policies must name us and any affiliates we designate as additional named insured parties. We currently require you to maintain the following insurance coverages: (1) commercial general liability insurance with limits of at least $2 million per occurrence, at least $4 million aggregate, and at least $2 million per person, with $5,000 per person medical benefits, and a maximum deductible of $2,500; (2) all risks coverage insurance on all furniture, fixtures, equipment, inventory, supplies and other property used in the operation of the Restaurant (including flood and/or earthquake coverage where there are known risks) for full replacement value; (3) workers compensation insurance consistent with applicable law;

According to Crepe De Licious's 2025 Franchise Disclosure Document, franchisees must purchase, install, maintain, and use fixtures, furnishings, equipment, signs, and supplies that conform to the standards and specifications outlined in the Operations Manual or in writing. Franchisees are also required to use computer programs and related materials, including the POS system software, developed for the operation of Crepe De Licious franchises. They must pay a technology fee for website hosting and other services, as well as a separate license fee for the POS software, which may be paid directly to the POS vendor or to Crepe De Licious.
Franchisees must purchase computer systems from designated suppliers and use the specified computer hardware and software, including the point-of-sale system. These items, along with software licenses, maintenance, and support services, must be obtained from suppliers specified by Crepe De Licious, which may include the franchisor or its affiliates. Additionally, franchisees are obligated to obtain insurance coverage that meets Crepe De Licious's requirements from an approved insurance company authorized to do business in the state where the franchise is located and rated "A" or better by A.M. Best & Company, Inc.
The required insurance coverages include commercial general liability insurance (with limits of at least $2 million per occurrence and $4 million aggregate), all risks coverage insurance on property for full replacement value, workers compensation insurance, data theft and cybersecurity coverage, and automobile liability insurance (with limits not less than $1,000,000 per occurrence and $2,000,000 aggregate). Crepe De Licious reserves the right to increase coverage amounts or require different or additional insurance coverage at any time, and franchisees must comply with these changes. All insurance policies must name Crepe De Licious and any designated affiliates as additional named insured parties. Franchisees may be required to obtain insurance coverage from Crepe De Licious's approved vendors.
